RESOLUTION 09 - ~1 <br />A RESOLUTION FORTHE CITY DF ELI~RIVER <br />A RESOLUTION DETERMINING .ASSESSED COST DF <br />TIVIPRaVEMENT AND ORDERING PREPARATION OF <br />PROPOSED ASSESSMENT ROLL TN THE MATTER OF <br />WINDSOR MEADOWS FINAL LIFT OF BITUMINOUS AND OTHER <br />ANCTLTIARY ITEMS IMPROVEMENT OF 2009 <br />WHEREAS costs have been determined for the ~lindsor Meadows Final Lift of Bituminous and other <br />Ancillary Items Tmprovefnent consisting o~ a contract price of $G3,000, and expenses <br />incurred ar to be incurred by tlae City in floe mal~~g of tl~e improvement in the amount of <br />X13,000, £or a total cost of tl~e improvement al' ~7b,000. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council o~ the City of Elk River, Minnesota: <br />1. Based upon the City Assessment Policies, it is determined that the portion o~ this improvement to be <br />paid by the City and not assessed to benefited properties is ~ ~0--. <br />2. The portion of tl~e cost to be assessed against benefited properties pursuant to tla.e Ells River City <br />Assessment Policies shall be ~7~,000. <br />3. The assessments shall be pa~Table in equal annual installments and shall extend Duct a period o~ 5 <br />years, the fast of the installments to be payable on or before file fast Monday in January, 2010, with <br />interest at the rate o~ 5.0% per annum from floe date of file adoption o~ the assessment resolution. <br />~, The City Administrator with the assistance of the Project Engineer shall ~ortl~witla calculate the <br />proper amount to be specially assessed for such iinprove~nent against every assessable lot, piece, or <br />parcel o~ land, without regard to cash valuation, as provided by law, and shall lave available at tl~e <br />City Administrator's off ce a copy o~ the proposed assessment roll for public inspection. <br />5. Upon completion o~ the proposed assessment roll, the City Administrator sl~all notify floe Council <br />and schedule a public hearing upon the proposed assessment, causing notice of the hearing by <br />publication and mail to be made at least t<vo weeks prior to the hearing. <br />Passed and adopted tl~.s 17th day of August, 2009. <br />~~ry w <br />Stepha ie A.
