O'Meara stated purpose of meeting is to better understand the issues and come to a <br />negotiated resolution without litigation. ISD 728 was planning to submit request for <br />water appropriation to use both wells but delayed for outcome of this meeting. <br />2. With opening comments by Adams and Bratlie, group reviewed Elk River Municipal <br />Utilities letter dated December 20, 2006 and DNR response on December 26, 2006. <br />Adams stated this irrigation well issue started three to four years ago when property was <br />being acquired. Elk River Municipal Utilities letter on August 4, 2006 was discussed, <br />Adams stated this offer was off the table because ISD did not respond, yet proceeded to <br />drill an additional well at Lincoln for irrigation purposes. <br />3. Bratlie implied it was ISD's intent to construct more irrigation wells as a cost saving <br />measure instead of paying higher water rates. <br />4. All agreed ISD can do a better job of following sprinkling restrictions and use moisture <br />meters to help reduce irrigation needs. <br />5. City and Utility ordinance was discussed. ISD is not convinced City can preclude them <br />from utilizing a well. (Language is weak, again verify with Peter Beck.) <br />6. DNR &MRW commended on requirements of wellhead protection plan. DNR stated <br />ISD's proposed wells will influence the municipal well. Due to Elk River having only <br />one aquifer, they are correct in being protective of this water source. <br />7. DNR commented on Elk River conservation plan and Elk River is carrying forward the <br />DNR request to promote conservation through rates. DNR stated that Elk River's 10 year <br />appropriation will carry a requirement to monitor Mt Simon aquifer with test wells. <br />
