RESOLUTION 01- 63 <br /> <br />A RESOLUTION OF THE CITY OF ELK RIVER <br /> <br />A RESOLUTION APPROVING SENATE FILE 1752; LEGISLATION <br />ALLOWING THE CITY OF ELK RIVER TO ISSUE SIX ADDITIONAL ON- <br />SALE LIQUOR LICENSES <br /> <br />WHEREAS, <br /> <br />the City Council adopted Resolution 00-lll in support of special <br />legislation to increase the number of on-sale intoxicating liquor licenses <br />to 18; and <br /> <br />WHEREAS, <br /> <br />special legislation has been adopted under Senate File #1752 allowing the <br />City of Elk River to increase its on-sale liquor licenses by six; and <br /> <br />WHEREAS, <br /> <br />without the special legislation the City would have to wait until the 2010 <br />Federal Census to increase its number of liquor licenses allowed by state <br />law from 12 to 18; and <br /> <br />WHEREAS, <br /> <br />the City requested the special legislation because it believed that limiting <br />the number of liquor licenses would restrict Elk River's future quality <br />growth in service areas such as restaurants, hotels, and conference <br />centers that are necessary to serve the residents and citizens of the City. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that Senate File #1752 reads as follows: <br /> <br />"The city of Elk River may issue six on-sale liquor licenses in addition to <br />the number authorized by law. All provisions of Minnesota Statutes, <br />Chapter 340A, non inconsistent with this section apply to the licenses <br />authorized by this section." <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council <br />approves the special legislation of Senate File #1752 which has been adopted into law. <br /> <br />Passed and adopted by the City Council of the City of Elk River this 10th day of September, <br />2001. <br /> <br />ATTEST: <br /> <br />Sandra A.
