'ity of <br /> <br />'ver <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br />ITEH 6.1. <br /> <br />MEMORANDUM <br /> <br /> Mayor and City Council <br /> Harlicker, Planning Assista~ <br /> Scott <br /> <br /> March 25, 1996 <br /> <br /> Raivala Variance Findings <br /> <br />The fo]lowing are findings in support of the granting of a front yard setback <br />variance request by Jim and Kathleen Raivala for property located at 18648 <br />Simonet Drive, Lot 3, Best Point of Lake Orono: <br /> <br />1. Literal enforcement of the Ordinance will cause undue hardship for the <br />apphcant. The granting of the variance will allow the apphcant to preserve <br />existing flower beds, a memorial flag pole and maintain a useable front yard. It <br />will also allow the neighbor continued enjoyment of their garden in that if the <br />variance is not granted, the garage will block off the hght for the garden. <br /> <br />2. There are special conditions which are pecuhar to this property. The adjacent <br />house is situated in such a way that their front windows look out over the <br />applicant's front yard. The granting of this variance will allow the construction <br />of the garage in a location that will minimize the impact on the neighbor's <br />house. <br /> <br />3. Literal application of the Ordinance will deprive the applicant of property <br />rights enjoyed by other properties in the neighborhood. There are three other <br />properties in the neighborhood that have constructed structures at a similar <br />setback from the street. <br /> <br />4. There are special conditions or circumstances that are not a consequence of <br />the apphcant's actions. The neighborhood was originally developed in the 1950's <br />and 1960's in a compact fashion with narrow setbacks. <br /> <br />5. The granting of this variance will be in keeping with the character of the <br />neighborhood.
