~y of <br /> <br />ver <br /> <br />TO: <br /> <br />FROM: <br /> <br />DATE: <br /> <br />SUBJECT: <br /> <br />ITEM 5.2. <br /> <br />MEMORANDUM <br /> <br /> Mayor & City Council <br /> <br /> Steve Rohlf, BZ Administrator <br /> February 26, 1996 <br /> <br /> Consider Wetland Mitigation by Dan <br /> Bowman <br /> <br />Issue <br /> <br />In order to construct the roads in the plat of Ridgewood Hills, it is necessary <br />to fill 1.71 acres of type 2 wetlands. There is a site plan attached showing <br />the location of the areas to be filled. That site plan also shows the location of <br />the 3.42 acres of wetland (at a ratio of 2 to 1) that will need to be created to <br />replace the wetland filled. <br /> <br />The City of Elk River is the Local Unit of Government (LGU) responsible for <br />reviewing this type of request for compliance with the Wetland Conservation <br />Act (WCA). The City's Technical Evaluation Panel reviewed this request. <br />This panel is made up of a representative from the State Board of Soil and <br />Water Resources, Sherburne Soil and Water Conservation District, City <br />Engineer Terry Maurer, and Stephen Rohlf. <br /> <br />We concluded that the request is in compliance with the WCA and offer the <br />following findings: <br /> <br />· The developer has minimized the impact on the wetlands as much as he <br /> could by modifying his plat (moving the road as far south as possible). <br />· The developer tried to avoid impacting the wetlands by trying to gain <br /> access to his property from adjacent property. <br />· Not being able to fill wetland would mean not being able to access the <br /> property, which would constitute a hardship. <br /> <br />Recommendation <br /> <br />The Technical Panel is recommending that the Council approves the wetland <br />mitigation plan for Mr. Bowman with the following conditions: <br /> <br />That this approval is subject to obtaining the necessary permit from <br />the Army Corps of Engineers. <br /> <br /> s:kb&z\steverkbow-wet.doc <br />13065 Orono Parkway · P.O.
