Item # 5I . <br />ver <br />MEMORANDUM <br />TO: Mayor and City Council <br />FROM: Terry Maurer, Public Works Director <br />DATE: June 9, 2008 <br />SUBJECT: Burandt Temporary Easement Compensation <br />hi an effort to help facilitate the continued discussion of the compensation to the Burandts <br />for the tempotaxy easement required fox the consuuction of 193r° Avenue, I have prepared <br />the attached exhibit. The exhibit shows in the cross-hatched area, the temporary easement <br />requested fiom the Burandts. The easement is 10,796 square feet (0.248 acres). As we <br />discussed last Mouday evening, these is the potenti<21 to give the Burandts addittonalland as <br />compensation after the. construction of 193`' Avenue. The city has acquired two parcels of <br />land that he immediatelti~ north of the Burandt's propextp on the west side They axe shown <br />on the exhibit as the Phoenix Enterprise acgtusition, and the Maas~7immerman acquisition. <br />Shown in shading adjacent to the north Burandt property line is a parcel of land that could <br />be given to the Burandts as equal area compensation for the temporary easement The ship <br />of land is 325 feet wide and results in a grant to them of 0.23 acres. Shown in two other <br />distinct shadings axe the temaindex of the Phoenix Enterprise acquisition of 0.32 acres and <br />the remainder of the 1tilass/7.imrnerman acquisition of 0.43 acres. Both of these parcels <br />could also be given to the Burandts after construction of the roadway and the grading of this <br />uca is complete. (~~ total of 0.97 acres) If these parcels are to be given to the Burandts, they <br />would need to be protected with a slope casement so that the grade of the property could <br />not be significantly changed in the fiiture. The final piece of shading adjacent Yo the toad is <br />a snip 20 feet wide that is approximately 0.24 acres. Tlvs is an area that I would suggest that <br />the city retani immediately outside of the 100-foot right-of-wap. 'T'his will provide a corridor <br />for small utilities to be placed and will also provide fox mahitenance of some minimal <br />xetainhig walls to be conch uctcd along This area. <br />Other information shown on this exhibit ie the 100-foot roadway right-of--way. As you can <br />see, the road was curved slightly to the north as it approaches "1'ylex Street and the <br />intersection in not at a true 90-degree angle. Phis was done to minimize impacts to the <br />Burandt property. 'T'hese is a small piece of property that the city acquired from the Smicjas <br />immediately south of the curve in the right-of-way. 'fhe city should retain ownerslvp of this <br />
