RESOLUTION 01- 29 <br /> <br /> A RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION OF THE CITY OF ELK RIVER <br />ACCEPTING MnDOT'S OFFER TO SELL A <br />MEMORANDUM OF CONDITIONS REGARDING THE <br />MULTIMODAL PARK AND RIDE FACILITY <br /> <br />WHEREAS <br /> <br />MnDOT anticipates constructing a Park and Ride facility on property <br />adjacent to the railroad tracks near 171st Avenue and Tyler Street; and <br /> <br />WHEREAS <br /> <br />the parking lot will require a stormwater quality control and detention <br />pond; and <br /> <br />WHEREAS <br /> <br />the outlet from this pond needs to cross City-owned property to get to the <br />outlet ditch. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, <br />Minnesota: <br /> <br />It is understood that only an easement will be granted even though (2) <br />State's title to said real estate shall pass to the State of Minnesota as of <br />the date of acceptance subject to conditions hereinafter stated. <br />The Mayor and City Clerk are authorized and directed to execute the <br />Offer to Sell a Memorandum of Conditions on behalf of the City. <br /> <br />Passed and adopted this 21st day of May, 2001. <br /> <br />ATTEST: <br /> <br />Sandra A.
