RESOLUTION 01- 28 <br /> <br />A RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br /> A RESOLUTION OF THE CITY OF ELK RIVER <br />GRANTING A HIGHWAY EASEMENT TO MnDOT FOR THE <br />PURPOSES OF DRAINAGE FROM THE MULTIMODAL LOT <br />LOCATED ALONG TYLER STREET <br /> <br />WHEREAS <br /> <br />MnDOT plans to construct a multimodal lot on property adjacent to the <br />railroad tracks near 171st Avenue and Tyler Street; and <br /> <br />WHEREAS <br /> <br />the parking lot will require a stormwater quality control and detention <br />pond;and <br /> <br />WHEREAS <br /> <br />the outlet from this pond needs to cross City-owned property to get to the <br />outlet ditch. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, <br />Minnesota: <br /> <br />The City Council does approve the highway easement for the multimodal <br />lot, understanding that the easement will be for drainage purposes only <br />and not used for any other construction. <br />The Mayor and City Clerk are authorized and directed to execute the <br />easement and retum it to MnDOT. <br /> <br />Passed and adopted this 21st day of May, 2001. <br /> <br />ATTEST: <br /> <br />Sandra A.
