Item # 5.4. <br />vet <br />MEMORANDUM <br />TO: City Council <br />FROM: Jeremy Barnhart, Planning Manager <br />DATE: May 12, 2008 <br />SUBJECT: Water/Sewer East of CR40 <br />In December of 2006, the City Council approved a land use amendment to the property <br />known as Liberty Heights Estates, changing the land use classification from rural residential <br />to urban residential. One of the conditions imposed by the Council was that should a <br />Planned Unit Development Agreement not be approved by the City by iVlaxch 2007, the <br />property could revert back to total residential, removing it from the urban services district. <br />Through 2007, staff was in constant contact with the main pxopexry owner of the area, <br />working on concepts and discussions toward fulfillment of the project. Since this action, <br />staff has been approached by several adjacent property owners, desiring an urban services <br />boundary extension fox their properties as well. <br />Since the PUD evas not approved in the required timeframe, the CouncIl is asked to <br />authorize the Comprehensive Plan amendment, changing the pxoperry from the urban <br />residential to rural residential. If authorized, staff will begin the formal amendment process. <br />Formal amendment of the Comprehensive Plan will require 4/5 vote of the Council, in <br />addition to public hearings at the Planning Commission and City Council. <br />
