Box 490 <br />Elk River, MN 55330-0490 <br /> <br />RE: UTILITY ASSESSMENTS ON 175TH AVENUE <br /> <br />Dear Council Members: <br /> <br />With the petition from the Developers of Park Pointe to install and pay for the sewer and water <br />under 175th from Tyler Street to their plat, together with the condition regarding this issue on the <br />final plat approval for Park Pointe, several of the property owners along 175th Avenue, from <br />whom the City is attempting to acquire right-of-way, have asked a question relative to sewer and <br />water assessments. <br /> <br />Basically, the question is if the Developer has paid for the installation of the sewer and water in <br />175th Avenue, will property owners on the north side of the road be assessed for these pipes in <br />the future when they hook up to them. City staff has collectively considered this question and <br />would recommend the following policy: <br /> <br />· If one of the large residential lots on the north side of 175th Avenue chooses to hook up to <br /> the sanitary sewer and water paid for by the Developer of Park Pointe, there would be no <br /> lateral or trunk assessments. The property owners would be required to extend the services <br /> to their home at their own cost and pay the appropriate SAC and WAC. In staff's view, there <br /> would be no precedent set by this policy since this is a unique circumstance where a <br /> Developer wanting to do "leap-frog" development prior to the time line in the Comprehensive <br /> Plan has decided to pay the additional cost for extending these services. <br /> <br /> If, in the future, any of the large residential lots on the north side of the road would split off <br /> property for additional residential development based on the sewer and water availability, <br /> this newly created lot would be assessed the going trunk rate for sanitary sewer and water <br /> at the time of the subdivision of the property. This would ensure that any property owner <br /> who split off a lot in the future would not get a competitive advantage over other developers <br /> in the City at the time. <br /> <br />If you have any questions regarding this proposed policy, I will be in attendance at your City <br />Council meeting on February 11, 2002. <br /> <br />Sincerely, <br /> <br />Howard R.
