RESOLUTION 99 -/-,0 <br /> <br /> RESOLUTION FOR THE CITY OF ELK RIVER <br />A RESOLUTION FOR VACATING A STREET RIGHT-OF-WAY <br /> <br />Case No. EV 99-2 <br /> <br />WHEREAS, the property owner abutting the street right-of-way has requested <br /> the City Council in a petition dated April 1, 1999, to vacate such <br /> right-of-way according to law; and, <br /> <br />WHEREAS, a public hearing was held on May 17, 1999, before the City Council <br /> at the Elk River City Hall on such petition after due published and <br /> posted notice had been given as well as personal notice to affected <br /> property owners on May 5, 1999, and all persons interested were <br /> given an opportunity to be heard; and, <br /> <br />WHEREAS, it appears that it will be in the best interest of the City to approve <br /> such petition. <br /> <br />NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and <br /> the right-of-way described as follows is hereby vacated: <br /> <br /> See attached Exhibit A <br />With the following condition: <br /> <br />The property owner of Lot 1, Block 1, grant an additional 30 foot <br />easement along the south side of the right-of-way for 215th Avenue for <br />streets, drainage and utilities. <br /> <br />Adopted by the Elk River City Council this 17th day of May, 1999. <br /> <br /> Stel~anie ' ' g,<M'ay~r <br />ATTEST: <br /> <br />Sandra Peine, City ~lerk <br /> <br />\ \ Elkriver \ sys \ SHRDO C \ DOCUMENT \ RE SOLUTI \ EV99-2.DOC <br /> <br /> <br />
