RESOLUTION NO. 72 <br />• CITY OF ELK RIVER <br />COUNTY OF SHERBURNE <br />STATE OF MINNESOTA <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK RIVER <br />AUTHORIZING EMINENT DOMAIN AND ACQUISITION OF REAL <br />PROPERTY IN ACCORDANCE WITH MINNESOTA STATUTES <br />CHAPTER 117 FOR THE 193'" N.W.AVENUE TRANSPORTATION <br />CORRIDOR AND ADOPTING APPROVED APPRAISALS OF VALUE. <br />Whereas, on February 20, 2007, the Ciry Council adopted Resolution No. 07-24, <br />Authorizing Eminent Domain and Acquisition of Real Property in Accordance with <br />Minnesota Statutes Chapter 117 fox the 193rd N.W. Avenue Transportation Corridor. <br />("Resolution Authorizing Condemnation"); <br />Whereas, the Resolution Authorizing Condemnation described certain real property <br />to be acquired by the City for the 193`d Avenue Extension Project. ("Property"); <br />Whereas, City staff has detem~ined that it is necessary and advisable to make certain <br />minor changes to the Property to be acquired fox the 193`d Avenue Extension Project. <br />• Whereas, the City staff has also obtained appraisals to estimate the just <br />compensation due and owing to the owners of the Property described in the Resolution <br />Authorizing Condemnation; <br />River. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk <br />1. The City of Elk River staff is hereby authorized and directed to take all <br />actions and to execute all documents and contracts necessary to acquire the <br />Real Property identified on Exhibit A ("Revised Real Property"). <br />2. All references in the Resolution Authorizing Condemnation to the term <br />"Real Property" shall be deemed to mean Revised Real Property. <br />3. The City ratifies all previous findings, resolutions and provisions in the <br />Resolution Authorizing Condemnation. <br />4. The City hereby adopts, as its approved appraisal of value fox the Revised <br />Real Property the appraisals of Patchin Messner and Dodd dated June 29, <br />2007. <br /> 'The motion fox adoption of the foregoing resolution was introduced by <br /> Councilmembex Morin and duly seconded by Counciltnember <br />. <br />
