<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION 07-~ <br /> <br />A RESOLUTION OF THE CITY OF ELK RIVER <br /> <br />A RESOLUTION APPROVING NOTICE OF <br />SUMMARY PUBLICATION OF ORDINANCE #07- 04 <br />AN ORDINANCE REPEALING ALL OF EXISTING SECTION 30.416- <br />EROSION AND SEDIMENT CONTROL, OF THE ELK RIVER MUNICIPAL <br />CODE, AND ADOPTING A NEW SECTION 30-416 OF THE ELK RIVER <br />MUNICIPAL CODE, EXCAVATION, GRADING, AND EROSION <br />CONTROL <br /> <br />WHEREAS, on June 18,2007 the Elk River City Council adopted Ordinance 07.()4 <br />Repealing Existing Section 30-416, Erosion and Sediment Control, of the Elk <br />River Municipal Code, and Adopting a New Section 30-416 of the Elk River <br />Municipal Code, Excavation, Grading, and Erosion Control; and <br /> <br />WHEREAS, new Section 30-416 sets forth rules and regulations to control excavation, <br />grading and earthwork construction, including fills and embankments; <br />establishes the administrative procedure for issuance of permits; and <br />provides for review of plans and inspection of grading construction; and <br /> <br />WHEREAS, a copy of the full text of the ordinance amending Section 30-416 of the Elk <br />River Municipal Code is available for inspection by any person at the office <br />of the Elk River City Clerk, 13065 Orono Parkway, during regular business <br />hours - 8:00 a.m. to 4:30 p.m., Monday through Friday. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Elk <br />River, by at least four-fifths vote, authorizes the publication of the title and <br />summary of Ordinance 07-04and that Ordinance 07-04shall become <br />effective upon adoption as provided by law. <br /> <br />Passed and adopted this 18th day of June 2007. <br /> <br />~u~ <br />.
