Due to the length of the ordinances, staff is also recommending adoption of the attaehed <br />resolutions approving summary publication of each ordinance. <br /> <br />Background/Discussion <br />At the April 16, 2007 City Council meeting, staff gave an update on the City of Elk River's NPDES <br />permit requirements. As stated at that meeting, a component of the permit is to adopt a Storm Water <br />Ordinance. An ordinance was provided to you at the meeting for your review. One change that has been <br />made since that meeting is in reference to penalties. This seetion has been omitted after review by the <br />City Attorney. <br /> <br />The City currently has a section in the ordinance on Erosion and Sediment Control (see. 30-416); <br />however, it does not cover all of the areas we ate required to undet the NPDES permit. Staff is <br />requesting that this section be repealed and replaeed with the attached Excavating, Gtading & Erosion <br />Control Otdinance. It is much more detailed as to what the requirements are. <br /> <br />The proposed Storm Water Ordinance is new. The language contained in this ordinance is similar to a <br />majority of other communities such as Woodbury, Valley Branch Watershed District, Brown's Creek <br />Watershed District, and Ramsey-Washington Metro Watershed District. The language is from sample <br />ordinances provided by the Minnesota Pollution Control Agency (MPCA) and the Northland Nonpoint <br />Education for Municipal Officials (NEMO) Program. <br />
