<br />e <br /> <br />e <br /> <br />e <br /> <br />RESOLUTION 07-30 <br /> <br />A RESOLUTION FOR THE CITY OF ELK RIVER <br /> <br />A RESOLUTION ESTABLISHING AN INTERIM ORDINANCE (MORATORIUM) ON THE <br />ISSUANCE OF BUILDING PERMITS FOR "ADVERTISING SIGNS" AND / OR SIGNAGE <br />THAT UTILIZES "ELECTRONIC CHANGEABLE COPY" FOR ONE YEAR FROM THE <br />DATE OF THIS RESOLUTION, <br /> <br />WHEREAS, State Statutes, Section 462.355 Subd 4 authorizes a City to enact an interim ordinance for the <br />purpose of considering the adoption or amendment of official controls as defined in Chapter <br />462; and <br /> <br />WHEREAS, The Elk River City Council (City Council) recognizes the emergcnce of new types of <br />Advertising Signs not contemplated with the City's current official controls; and <br /> <br />WHEREAS, The City Council has observed the proliferation of signs with electronic changeable copy; <br />and <br /> <br />WHEREAS, The City Council has noted that thc city's current official controls regulating changeable <br />copy are not clear as to the definition of changeable copy versus animation, and need to be <br />updated to address new developments with respect to signs with electronic changeable copy; <br />and <br /> <br />WHEREAS, The City Council desires to review and make necessary changes to the City's Official <br />Controls to ensure that the health, safety, and general welfare of the residents and visitors of <br />Elk River are preserved; and <br /> <br />WHEREAS, The City Council has determined that it is critical that a comprehensive review of and <br />potential amendment to the City's Official Controls be conducted without the simultaneous <br />review of building permits for said signs. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: <br /> <br />1. A Moratorium is hereby established, prohibiting the issuance of building pennits for new or existing <br /> <br />Advertising Signs and Electronic Changeable Copy, as defined in the Elk River Code of Ordinances. <br /> <br />2. However, a building pennit may be granted if the following conditions are met: <br />A. If the pennit is for the replacement of an existing Advertising Sign with an identical <br />Advertising sign and no electrical work is necessary or requested. <br />B. If the pennit is for the repair of an existing Advertising Sign and no electrical work is <br />necessary or requested. <br /> <br />3. The City Council directs the Community Development Department and the Planning Commission to <br />complete an analysis of issues associated with Advertising Signs and "Electronic Changeable Copy" signs <br />and develop an advisory recommendation for the City Council to consider potential City Ordinance <br />amendments. <br /> <br />07-30 <br />
