City of Elk River REQUEST FOR COUNCIL ACTION Agenda Section Meeting Date Administration 16, 2007 Item Description Consider Severance Package for City Prosecuting Attorney Chris ohnson Administrator Introduction The decision was made recently to contract for city prosecution services; therefore, the position of city prosecuting attorney will be eliminated once the prosecuting duties have been transferred to the consulting attorney. Severance pay to current city prosecutor Chris Johnson has been discussed by both the Prosecuting Attorney committee and the City Council. The Council is asked to consider a severance pay package to Mr. Johnson. Discussion The Committee previously discussed severance pay for Mr. Johnson and suggested that Mr. Johnson should continue to be paid through March 31 or until he becomes employed, whichever comes earlier, and that he be allowed to carry insurance through the city and the city's current contribution to insurance benefits continue through June 30 or until he qualifies for insurance through other employment, whichever comes earlier. Mr. Johnson's actual last day of employment with the City will be the date when the final transition has been made to the consulting attorney, currently expected to be January 29 based on the proposed contract for prosecuting services. If there is other work that needs to be completed by Mr. Johnson, that date may change. Under this proposal, unless he becomes employed elsewhere, he will be paid through March 31 even if his actual last day of work is earlier than March 31. Financial Impact Payment of salary and benefits as stated above will total approximately $19,700. Attachments None Action Requested The Council is asked to approve severance pay for Chris Johnson.
