We have had discussions with Tony Emmerich regarding his schedule to <br />proceed with improvements within that plat. Construction of the plat requires extension of <br />the trunk sanitary sewer, water, and storm sewer along with the street on Orono Parkway <br />from its current location to at least Joplin Avenue. This plat will also require the <br />construction of Joplin from County Road 30 to Orono Parkway. There have been <br />discussions about the further extension of Joplin from Orono Parkway to TH 10. Along with <br />the street construction, the issue of utilities beneath it need to be explored. Also, the County <br />Board recently passed a resolution authorizing a petition for City utilities to serve the County <br />building. I understand City Attorney Peter Beck is currently drafting a petition form which <br />will waive the County's right to appeal their assessments for these improvements. <br /> <br />If the City Council desires to look at the feasibility of extending trunk utilities to serve the <br />County building along with the necessary improvements associated with the Country <br />Crossings Addition, the first step would be adopting a resolution authorizing a feasibility <br />study. I do not believe that the County action would ever constitute a legal petition since <br />they do not represent more than 35 % of the affected property to be served by these proposed <br />improvements. Therefore, I have attached a draft resolution for the City Council's <br />consideration which authorizes a feasibility study without regard to the adequacy of the <br />petition from the County. This petition would essentially initiate the project by Council <br />direction; therefore, it requires a 4/5 vote. <br /> <br />I would envision the feasibility for these improvements to touch on many issues, including <br />trunk utilities extended out to and possibly across the County property, the extension of <br />Orono Parkway from its current location to Joplin, the extension of Joplin from County Road <br />30 to Orono Parkway, and potentially to TH 10. The issue of trunk and possibly lateral <br />utilities throughout the Sandpiper Estates Development and also the issue of whether or not <br />a road should be constructed between Sandpiper Estates and Joplin. <br /> <br />223-2804.apr <br />
