ITEM # 5. 1.

.

MEMORANDUM

TO:

FROM:

Planning Commission
Rebecca Haug, Environmental Administrator t ~

DATE:

April 11 , 2006

SUBJECT:

Amend Conditional Use Permit for Mineral Excavation by
Midwest Asphalt Corp. CU 06-04

.

Request: Midwest Asphalt Corp is requesting a conditional use permit to continue
extraction of sand and gravel from their Elk River facility located at 12168 221't Ave NW.
Midwest Asphalt Corp has been operating under a CUP that was issued in 1981. Howe\Ter,
the CUP had an expiration date of 20 years so they have been operating without a CUP for
the past five years. This was an oversight by both staff and Midwest Asphalt up until this
year. They plan to continue mining to provide aggregate products to be used for unpaved
road maintenance, highway base projects, the making of Hot Mix Asphalt, the making of
concrete for various construction projects in the area. The site was included in the City of
Elk River's 1994 Environmental Impact Statement (EIS) on Mineral Excavation and the
processes and practices will stay consistent with those in the EIS.

Attachments: Below is a list of items included in your packet. Please let staff know if you
need additional copies.
~ A Conditional Use Permit (CUP)
~, Applicants application for a CUP
~ Letter from Matt Ledvina, City's Environmental Consultant
~ Letter from Cliff Anderson, City of Elk River Fire Chief
~ a vicinity map;
~ Property boundary map
~ Operation Plan map

Issues:

Matt Ledvina, City's Environmental Consultant listed items in his memo dated March 27,
. 2006.
