Park Dedication Fees shall be paid for one dwelling unit at the rate applicable when the subdivision is <br />released for recording. <br />2. The developer shall extend 215th Ave to the western end of the plat. The road shall end at a cul-de-sac, <br />built to city standards. <br />3. Council approval of a Development Agreement outlining the responsibilities of the developer. <br />4. A Letter of Credit shall be provided to the city in the amount of 100% of the costs of the public <br />improvements. <br />5. Upon completion of all improvements and acceptance by the city, a security or warranty in a form <br />acceptable to the Public Works Director must be secured. <br /> <br /> <br />Background/Discussion <br />The property is zoned Single Family Residential (R1a), where the ordinance requires a minimum lot size of 2 <br />½ acres. The applicant is requesting a preliminary and final plat to subdivide their 15.85-acre property into <br />two parcels. Lot 1 will be 3.24± acres in size, and Lot 2 will be 12.32± acres. Access to lots 1 and 2 will be <br />from 215th Avenue. The parcels meet the dimensional requirements for the R1a district. One parcel is eligible <br />for park dedication. <br /> <br />Planning Commission <br />The Planning Commission held a public hearing on March 25, 2025. Numerous residents spoke during the <br />public hearing, with the main topic of concern related to the group home operation on the subject parcel. <br />Staff informed the commission that the state regulates group homes and the city is required to allow them in <br />residential zoning districts. <br />The Commission understood the city limits on group home regulations and had no concerns with the <br />proposed subdivision. The Commission unanimously recommended approval of the preliminary plat. <br />Page 133 of 197
