City of Elk - River To City Council Meeting Date May 20, 2024 Item Description Conditional Use Permit: PUD Amendment for Taco Bell Signage Request for Action Item Number 7.1 Prepared By Chris Leeseberg, Senior Planner Reviewed by: Zack Carlton Cal Portner Tina Allard Action Requested Approve, by motion, a PUD amendment limiting the freestanding sign height consistent with the C-3 (Highway Commercial) sign ordinance. Background/Discussion (Case No. CU 24-05) The property is zoned Planned Unit Development (PUD) where changes to size regulations ("variances") require a Conditional Use Permit (CUP) to amend the PUD agreement. The applicant seeks a CUP to allow signage consistent with the C-3 (Highway Commercial) sign ordinance. On April 15, 2024, the City Council approved an amendment to Section 30-871 essentially capping sign heights to 40 feet above the nearest point grade of the main line of Highway 169. The ordinance also does account for grade changes along Highway 169. Many commercial properties along Highway 169 that would benefit from this amendment are in PUD districts and the city cannot initiate an amendment to those standards. Landowners within each PUD will need to request an amendment to their sign regulations, as this request is doing. Planning Commission During the public hearing, no one spoke for or against the request and staff has not received any comments since the commission meeting. The Planning Commission had no questions or concerns about the request and unanimously recommended approval.
