RESOLUTION NO. 24-11 <br />BOARD OF COMMISSIONERS <br />ELK RIVER MUNICIPAL UTILITIES <br />A RESOLUTION APPROVING ACQUISITION OF REAL PROPERTY <br />FROM THE CITY OF ELK RIVER <br />WHEREAS, the City of Elk River ("City") is the fee owner of the real property located at in the City <br />of Elk River, County of Sherburne, State of Minnesota, which is legally described as follows: <br />Lot 1, Block 1, Natures Edge Business Center Third Addition <br />(PID: 75-00915-0105) (the "Property"); <br />WHEREAS, the City Council of the City of Elk River adopted Resolution No. 24-11, approving the <br />conveyance of the Property to Elk River Municipal Utilities, a Minnesota municipal utility <br />("ERMU"), for use as a substation; <br />WHEREAS, ERMU wishes to accept the Property for this purpose and use; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE BOARD OF COMMISSIONERS OF ELK RIVER <br />MUNICIPAL UTILITIES, BASED UPON THE FOREGOING RECITALS INCORPORATED HEREIN, AS <br />FOLLOWS: <br />1. The acquisition of the Property by ERMU from the City of Elk River by Quit Claim Deed is <br />approved. <br />2. ERMU will cooperate with the City of Elk River in the execution and recording of the Quit <br />Claim Deed and any other documents necessary to the completion of the conveyance, if <br />any. <br />3. The Chair of the ERMU Board of Commissioners and the ERMU General Manager are <br />authorized to execute any documents necessary to the completion of the conveyance, if <br />any. <br />This Resolution Passed and Adopted this 8th day of October, <br />n J.lVietz, <br />Mark Hanson, General Manager <br />232693v1 <br />
