Request for Action

To Item Number
Planning Commission 9.1
Agenda Section Meeting Date Prepared by
Work Session January 23, 2024 Zack Carlton, Community Development Director
Item Description Reviewed by
Concept Review: Draft New Ordinance to Support Chris Leeseberg, Senior Planner
Platting Small Parcels, Case No. CR 24-01
Reviewed by

Action Requested
Provide the applicant with informal feedback regarding their request for a new ordinance related to platting small
parcels.

Background/Discussion
The applicant has requested feedback from the Planning Commission regarding their proposal to develop a new
ordinance that would allow platting or boundary line adjustments for minor changes that would otherwise require
a full plat.

Specifically, the applicant owns an 8.1-acre parcel which has been platted as Lot 1, Block 1, Beaudry Elk River
Addition. He would like to complete a boundary line adjustment to add approximately 1,000 SF of an adjacent
non-platted (metes and bounds) parcel to his platted parcel.

The current ordinance permits this lot adjustment through the platted exemption process, which requires both
properties to be platted. Staff created this process to address situations like this, but the changes generally do not
contemplate such a minor change. The applicant and owner of the adjacent parcel have concerns with the costs
associated with platting a 20-acre parcel to split off approximately 1,000 SF. This is a unique situation and the
applicant would like the city to create an ordinance that would allow these small changes without platting both
parcels in their entirety.

Financial Impact
None – the applicant would be required to apply for an ordinance amendment and the legal costs would be the
responsibility of the applicant.

Mission/Policy/Goal
Support the growth and development of the city’s residential and business communities.

Attachments
None

The Elk River Vision
A welcoming community with revolutionary and spirited resourcefulness, exceptional

service, and community engagement that encourages and inspires prosperity.
Updated: January 2023
