�, <br />Elk s �- <br />River <br />Request for Action <br />To Item Number <br />Ma Tor and CinT Council 7.2 a <br />Agenda Section Meeting Date Prepared by <br />Public Hearin s une 20, 2023 Chris Leeseber , Senior Planner <br />Item Description Reviewed by <br />Waste Management — Elk River Landfill, LLC, 221 st Zack Carlton, Communitv Develo ment Director <br />Avenue/22460 US Highway 169 Reviewed by <br />Ordinance: Solid Waste Facility Overlay District Cal Portner, Cit�T Administrator <br />Action Requested <br />Adopt, by motion, an ordinance amending CityT Ordinance Section 30-1834 SWF solid waste facilit�r overlayT <br />district. <br />Background/Discussion <br />Case No. OA 23-02 - The Elk River Landfill (ERL) applied foY a Conditional Use PeYmit (CUP), case numbeY CU <br />23-09, to amend their CUP to incorporate appro�matelyT 20 additional acres of propernT, immediatelyT to the south <br />of the currently permitted landfill footprint The additional land provides no additional capacityT for Municipal <br />Solid Waste (landfill expansion) but will be used for improved/required stormwater management. <br />CurrentlyT, no portion of a solid waste facilityT, including any portion of a solid waste facilityT, easements, water or air <br />rights, storm�vater management facilities, and all buffer areas or buffer zones can occur outside of the Solid Waste <br />FacilityT (SWF) overlay district. <br />For the CUP to be processed, ERL is proposing an ordinance amendment to Section 30-1834(e) to allo`v for <br />stoYmwateY management featuYes for the landfill to be located outside of the SWF overla�r district The <br />amendment has been drafted to allo�v on1�T storm�vater facilities serving approved SWF facilities to be located <br />outside of the SWF overlay district if on a Zoning Lot (adjacent lot undeY common owneYship). <br />Planning Commission <br />During the public hearing, no one spoke for or against the request and staff has not received anyT comments since <br />the commission meeting.
