The 2011 Agreement for Issuance of Amended <br />Conditional Use Permit shall be amended to allow the <br />construction and use of a stormwater pond on a parcel <br />(75-104-1101) outside of the Solid Waste Facility (SWF) <br />overlay district. <br />2. There shall be no additional Municipal Solid Waste <br />capacity beyond what was approved in 2011. <br /> <br />Background/Discussion <br />The Elk River Landfill (ERL) is requesting a Conditional Use Permit <br />(CUP) to amend their existing CUP to incorporate approximately 20 <br />additional acres of property, immediately to the south of the currently <br />permitted landfill footprint. The additional land provides no additional <br />Municipal Solid Waste capacity (landfill expansion) but will be used <br />for improved/required stormwater management. <br /> <br />In order to process the CUP amendment, ERL also requested an <br />ordinance amendment (OA 23-02) to allow for stormwater <br />management features for the landfill to be located outside of the SWF <br />overlay district. The additional property will allow ERL to construct <br />one large stormwater basin to replace the currently permitted design which included two sedimentation basins and <br />would have required a lift station. <br /> <br />The modifications will allow surface flow of stormwater management (eliminating the lift station). The previous <br />design had stormwater discharge from the site under the exterior roadway, then under the city trail, and ultimately <br />to an upstream wetland on property owned by ERL.
