SWF solid <br />Suzanne Fischer, Environment Services/Special Projects <br />waste facility overlay district, Case No. OA 23-02 <br />Director <br /> <br />Action Requested <br />Recommend, by motion, approval of the ordinance amendment as drafted. <br /> <br />Background/Discussion <br />The Elk River Landfill (ERL) submitted an application for a Conditional Use Permit (CUP), case number CU 23- <br />09, to amend their CUP to incorporate approximately 20 additional acres of property, immediately to the south of <br />the currently permitted landfill footprint. The additional land provides no additional capacity for Municipal Solid <br />Waste (landfill expansion) but will be used for improved/required stormwater management. <br /> <br />Currently, no portion of a solid waste facility, including any portion of a solid waste facility, easements, water or air <br />rights, stormwater management facilities, and all buffer areas or buffer zones can occur outside of the Solid Waste <br />Facility (SWF) overlay district. <br /> <br />For the CUP to be processed, ERL is proposing an ordinance amendment to Section 30-1834(e) to allow for <br />stormwater management features for the landfill to be located outside of the SWF overlay district. The <br />amendment has been drafted to allow only stormwater facilities serving approved SWF facilities to be located <br />outside of the SWF overlay district if on a Zoning Lot (adjacent lot under common ownership). <br /> <br />A Zoning Lot means a parcel of land occupied or used or intended for occupancy or use for a purpose identified <br />in article VI of this chapter and identified as such for the purposes of zero lot line development. The parcel shall <br />abut a public street and shall be of sufficient size to satisfy and meet all dimensional regulations required by article <br />VI of this chapter.
