Request for Action <br />To <br />Item Number <br />Mayor and City Council <br />7.1 <br />Agenda Section <br />Meeting Date <br />Prepared by <br />Public Hearings <br />May 15, 2023 <br />Zack Carlton, Community Development Director <br />Item Description <br />Reviewed by <br />Ordinance Amendment: Allow Motor Vehicle Sales in <br />Cal Portner, City Administrator <br />the I-3 Zoning District, Rock Solid Companies — Ron <br />Reviewed by <br />Touchette <br />Action Requested <br />Adopt, by motion, an ordinance adding motor vehicle sales as a permitted use in the I-3 (General Industrial) <br />zoning district. <br />Background/Discussion <br />Case No. OA 23-01 - The applicant has requested that motor vehicle sales be added as a permitted use in the I-3 <br />(General Industrial) zoning district. The applicant notes that vehicle sales are permitted in the I-1 (Light Industrial) <br />and I-2 (Medium Industrial) as conditional uses and that the amendment would make the I-3 district, generally a <br />heavier use industrial district, consistent with the others. <br />Staff, in reviewing this request, also compared the request to the C-3, Highway Commercial, district where auto <br />sales are allowed as a permitted use. Similar uses in the I-3 district include motor vehicle storage (CUP), salvage <br />yards (CUP), and motor vehicle repair shops (permitted). <br />Amending the ordinance to allow motor vehicle sales as an allowed use rather than permitting with an Interim Use <br />Permit, or a Planned Unit Development project will allow the use on any parcel within the district. The I-3 district <br />is relatively compact and isolated in the southeast corner of the community and abuts commercial uses along <br />Highway 10, where auto sales and salvage yards are allowed. <br />Staff recommend amending the ordinance to allow motor vehicle sales as a permitted use, requiring administrative <br />review rather than a Conditional Use Permit, in the I-3 zoning district. <br />Planning Commission <br />The Commission reviewed the request during their April 24, 2023, regular meeting. No one spoke during the <br />public hearing, and we have not received any additional comments from the public.
