The general purpose and intent of the ordinance are met. <br />2. The property has a land use of residential and the use is <br />consistent with the comprehensive plan. <br />3. The proposed use is reasonable and is permitted in the zoning <br />ordinance. <br />4. The plight of the petitioner is due to circumstances unique to <br />the property not a consequence of the petitioner’s own action <br />or inaction. <br />5. The variance will not alter the essential character of the locality. <br /> <br />Background/Discussion <br />The subject property, along the Elk River, is zoned R-1b (single family <br />residential) and is 0.27 acres in size. Setbacks for this zoning district are <br />as follows: <br /> <br />Front: 35’ (requesting to be 18’ from front property line, a 17’ variance) <br />Side: 10’ <br />Garage: 5’ <br />Rear: 25’ <br /> <br />The property currently does not have any garage/shed space and the property owners are requesting a variance <br />approval to permit the construction of a 22’ x 26’ attached garage within the required front yard setback. The <br />garage will be located approximately 18 feet from the front property line along 189th Avenue. Approval would <br />allow a 17-foot variance. <br /> <br />A variance was approved in 2007 for a similar request (detached accessory structure) on the property directly <br />adjacent to the west.
