AMENDMENT TO <br /> <br />MINNESOTA MUNICIPAL POWER AGENCY <br />POWER SALES AGREEMENT <br /> <br /> THIS AMENDMENT, entered into and made effective as of the ____ day of <br />_______________, 2022, hereby amends the Agreement known as the Minnesota <br />Municipal Power Agency Power Sales Agreement, as amended, by and between the <br />Minnesota Municipal Power Agency (“Agency”), a municipal power agency and political <br />subdivision of the State of Minnesota, and the CITY OF ELK RIVER by its Utilities <br />Commission, a municipal corporation of the State of Minnesota and a member of the <br />Agency (“Member”), dated May 14, 2013 (hereinafter referred to as the “Agreement”). <br /> WHEREAS, the Agency and the Member wish to amend the term of the <br />Agreement as set forth below: <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br />Section 7 of the Agreement, which currently provides as follows: <br /> SECTION 7. Term <br /> This Agreement shall remain in effect through December 31, 2050, <br />and if not then terminated by at least 5 years prior written notice <br />given by either party to the other, shall continue in full force and <br />effect until so terminated. <br /> <br />shall be replaced in its entirety by the following paragraph: <br /> SECTION 7. Term <br /> <br />This Agreement shall remain in effect through December 31, <br />2060, and if not then terminated by at least 5 years prior <br />written notice given by either party to the other, shall <br />continue in full force and effect until so terminated. <br /> <br /> <br /> <br />52
