Or ■ If Council requires a sound study, the applicant will need to provide a written request for extension, or Council must deny the CUP request during the July 18, 2022, regular meeting as there would not be enough time to conduct one by July 26, 2022. Background/Discussion The Council postponed action on the Conditional Use Permit (CUP) at their May 16, 2022, meeting requesting a sound study be completed. After that meeting, the applicant requested a work session with the Council to discuss the expectations the Council had for the sound study. Discussion included where and how often studies should occur along with the merits of a study. The applicant indicated there are five events each year that generate most of the noise complaints. After the Council discussed the merits of conducting a sound study, they directed staff to research other racetracks in the state. Staff reached out to Princeton Speedway and Elko Speedway and Drive-in Theater and have included information received from those two operations. Princeton Speedway has no mitigation measures in place, other than a curfew (similar to CUP standards for ERX) and Elko Speedway stated a noise assessment was conducted in 2005 and was associated with some platting and development of the track property. The noise study is included in the attachments and staff contacted the consultant that completed the investigation. They noted that a similar study could be turned around in 2-3 weeks upon completion of collecting the desired readings. The overall timeline would depend on how often data is expected to be taken. The consultant indicated a rough ballpark estimate would be $5,000-10,000, noting it will depend on many factors. Per state statue, the city must act on this item by July 26, 2022, unless the applicant requests in writing the 60-day rule be waived.
