Request for Action <br />To Item Number <br />Ma Tor and CinT Council 7.3 <br />Agenda Section Meeting Date Prepared by <br />Public Hearings June 20, 2022 Chris Leeseberg, Senior Planner <br />Item Description Reviewed by <br />OYdinance Amendment Section 30-793, Zack Carlton, Communitv Develo ment DirectoY <br />AccessoryT Buildings, Cit�T of Elk River Reviewed by <br />Cal Portner, Ci r Administrator <br />Action Requested <br />Adopt, byT motion, an ordinance amending CityT Ordinance Section 30-793, AccessoryT Buildings. <br />Background/Discussion <br />Case No. OA 22-04 - Staff receives numerous calls from propert�- owners that have 1+ acres of land within the <br />Urban Service District (USD) inquiring ho�v much garage/shed space theyT can have and often are frustrated `vhen <br />they Yealize the size limit applies to all pYopeYties less than 5 acYes. <br />A one-acre paYcel is allowed 1,200 sf. but if that paYcel were to be subdivided into three parcels (B-1 c allo2��s 19,000 <br />sg. ft. lots� the allowed square footage foY the same aYea would then be 3,600 sf. <br />The Planning Commission recommends allowing 1+ acre parcels in the R-lb, R-lc, and R-ld zones to follow the <br />one-acre limitation in the R1-a district, `vhich `vould be 2,500 sf. <br />Additionally, the table in Section 30-793 (c) should be removed as any remaining larger lots in the USD mayT be <br />subdivided. This prevents, for example, a 10-acYe parcel building a 4,500-sf shop and then lateY subdividing the 10- <br />acYes into 11,000 — 14,000 sf. parcels with one of them containing what would then be an out of scale, to the <br />development, legal non-conforming structure. <br />Also, there are residents living within the USD that have 1+ acres and drive a tractor trailer for a living. The <br />ordinance limits tractor trailer parking in the R-1a district on parcels greater than five acres or with a CUP on lots <br />less than five acYes. FuYther, the oYdinance does not allow the paYking of a truck tractoY and/oY trailer, in excess of <br />7,000 pounds gross `veight, on public propertyT (right-of-`vayT) within an area zoned residentiaL The on1�T option for <br />these Yesidents is to paYk their tractoY traileY in an accessory structuYe ��hich needs appro�mately 800-1,000 sf. <br />Staff and the Commission also recommend some "housekeeping" amendments.
