COMMISSIONER FUCHS SECONDED THE MOTION.
THE MOTION PASSED 6-0.

4. Variance Request by Oak Crest Partnership/Public Hearing

Chairman Wilson introduced the request of Oak Crest Partnership for a 5
foot encroachment on the 10 foot rear setback for a garage in an R4
district. and also a 3 foot encroachment on the 5 foot side yard setback
for the same garage. Chairman Wilson explained that the rear yard setback
encroachment is requested in order to keep the garage on Parcel C in line
with the garage on Parcel B. Lot 10. Block 4. Auditor's Subdivision No.
5. which is also only 5 feet from the lot line.

Mr. Rohlf stated that this setback was missed by staff during inspection
of the garage on Parcel B. Mr. Rohlf noted that he was informed the
developer own the property to the north of the garages so that if the
variance is denied. 5 feet could be added to the parcel to create the
proper setback. With this in mind. Mr. Rohlf. stated that he did allow
the developer to pour the slab for the garage.
