Request for Action <br /> <br /> <br /> <br /> <br />To Item Number <br />Planning Commission 6.1 <br />Agenda Section Meeting Date Prepared by <br />General Business January 25, 2022 Zack Carlton, Planning Manager <br />Item Description Reviewed by <br />Ordinance Amendment: Administrative Review of Chris Leeseberg, Senior Planner <br />Permitted Uses <br />Reviewed by <br /> <br /> <br />Action Requested <br />Recommend, by motion, an ordinance outlining the administrative review process for permitted uses. <br /> <br />Background/Discussion <br />The city’s zoning ordinance outline permitted, accessory, and conditional uses for the various zoning <br />districts in the community. Ordinance further describes numerous performance standards for the <br />different uses – setbacks, parking standards, landscaping, fencing, etc. Staff reviews projects based on the <br />standards outlined in the ordinance and in the case of Conditional Uses, processes a CUP which is then <br />reviewed by the Planning Commission and approved by the City Council. That process is clearly outlined <br />in the ordinance and on the corresponding CUP application. <br /> <br />However, the ordinance is not as clear when it comes to permitted uses. The city’s authority to review a <br />use based on the standards outlined in the ordinance is clearly stated in Secs. 30-602 and 30-604, but the <br />process for that review is not as clear as it should be. <br /> <br />Staff is seeking direction from the Planning Commission to draft an ordinance outlining the <br />administrative review process for permitted uses described in the ordinance. The review would not <br />require Planning Commission or Council approval and would remain a staff level approval. The <br />ordinance would not create an additional burden or roadblock for an applicant, rather the goal is to <br />clearly spell out the development review process for permitted multi-family, commercial, and industrial <br />uses. <br /> <br />Staff will provide the Commission with a draft ordinance for discussion during the meeting. <br /> <br />Financial Impact <br />None <br /> <br />Attachments <br /> None <br /> <br />The Elk River Vision <br />A welcoming community with revolutionary and spirited resourcefulness, exceptional <br />service, and community engagement that encourages and inspires prosperity <br />
