. CITY OF ELK RIVER ORDINANCE NO. 80-3 WHEREAS, the City of Elk River is empowered pursuant to Minnesota Statutes Section 462.354 to revise and establish a planning commission. NOW, THEREFORE, be it enacted by the City of Elk River: 214 - Planning Commission 214.00 Establishment of Planning Commission. There is hereby established in the City of Elk River, a planning commission pursuant to Minnesota Statutes, Section 462.354. 214.02 Members and Term. The Planning Commission shall consist of five (5) members appointed by the City Council at the first meeting of the year for terms of 3 years. A vacancy shall be filled by the City Council for the remainder of the term. The members of the Planning Commission by a majority vote shall elect one of the appointed commissioners at the first meeting of the year to serve as chairman. . 214.04 Powers and Duties. The Planning Commission shall have and exercise the powers and duties conferred upon such commissions by the Municipal Planning Act (Minnesota Statutes, Section 462.351 to 462.364) and by Ordinance rules and regulations of the City. 214.06 Meetings and Procedure. The Commission shall meet regularly on the fourth Monday of each month. Special meetings may be held at any time upon the call of the Chairperson. Notice of the time and place of a special meeting shall be communicated to the members and publically noticed at least three days prior to the meeting except in the event of an emergency. A majority of the Commission members shall constitute a quorum. All Commission me~tings shall be open to the public. Except as provided herein, the Commis- sion shall be governed by and operate pursuant to Roberts Rules of Order as most recently revised. Repealer. All ordinances and ordinance provlslon in conflict with the provisions contained herein are hereby repealed. Section 2.
