<br />ORDINANCE 81-6B <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 900 BY RE-DEFINING AND <br />CHANGING STANDARDS FOR HOME OCCUPATIONS <br /> <br />The City Council of the City of Elk River does ordain as follows: <br /> <br />Section 8. Section 8 of Ordinance No. 900 of the Elk River Municipal Code which <br />relates to definitions used in the Zoning Ordinance is hereby amended <br />to read as follows: <br /> <br />30 -Home Occupations. A service business customarily conducted <br />entirely within a dwelling principally by members of a family <br />residing therein which use is clearly incidental and secondary <br />to the use of the dwelling for residential purposes and does <br />not change the character thereof. <br /> <br />Section 20. Subsection 3 of Section 20 of Ordinance No. 900 of the Elk River <br />Municipal Code which relates to conditional uses under the City Zoning <br />Ordinance is hereby amended to read as follows: <br /> <br />3 - Home Occupations. A home occupation may be established and <br />conducted only in accordance with the following requirements <br />following receipt of a conditional use permit as outlined in <br />Section 900.42 of the Zoning Ordinance. <br /> <br />a. Subordinate Use - The use of the dwelling unit for <br />the home occupation shall be clearly incidental and subordinate <br />to its residential use. <br /> <br />b. Outside Appearance - Conduct of the home occupation shall <br />result in no substantial change in the outside appearance of <br />the buildings or land. If such change is allowed, it shall <br />have no contrasting difference from the existing structure. <br />Any sign or visible advertisements authorized in the conditional <br />use permit shall not exceed two (2) square feet in area and shall <br />be mounted flat on the outside wall of the dwelling. <br /> <br />c. Hours of Operation - Hours of operation for such occupations <br />shall be in accordance with the conditional use permit. <br /> <br />d. Non-Resident Employees - The number of non-resident employees <br />which may be employed as part of the occupation may be limited <br />by the terms of the conditional use permit. <br /> <br />e. Traffic - No traffic shall be generated by such home occupation <br />in greater volume than would normally be expected in a residential <br />
