<br />. <br /> <br />. <br /> <br />. <br /> <br />h' NJ4- L <br /> <br />( <br /> <br />ORDINANCE NO. 86-18 <br /> <br />AN ORDINANCE AMENDING CHAPTERS VI AND IX OF THE ELK RIVER <br />CITY CODE, CREATING A NEW SOLID WASTE FACILITY ZONING <br />DISTRICT, ESTABLISHING STANDARDS FOR AND REGULATING THE <br />OPERATION OF SOLID WASTE FACILITIES IN THE CITY OF ELK <br />RIVER, REQUIRING LICENSES FOR THE ESTABLISHMENT AND <br />OPERATION OF SOLID WASTE FACILITIES, ESTABLISHING A <br />REQUIREMENT FOR A PERFORMANCE BOND AND ESTABLISHING <br />PENALTIES FOR LACK OF COMPLIANCE WITH THESE PROVISIONS, ALL <br />IN ORDER TO PROMOTE THE HEALTH, WELFARE, AND SAFETY OF THE <br />PUBLIC. <br /> <br />The City Council of the City of Elk River does hereby <br />ordain as follows: <br /> <br />1. <br /> <br />Chapter IX of the Elk River City Code is hereby amended as <br />follows: <br /> <br />A. Section 900.08 is amended by adding the following <br />definitions thereto: <br /> <br />"53A. Sanitary Landfill. "Sanitary Landfill" shall <br />be defined as set forth in Section 604.02 of the City <br />Code. <br /> <br />64A. Solid Waste Facility. "Solid Waste Facility" <br />shall be defined as set forth in section 604.02 of <br />the City Code. <br /> <br />64B. Solid Waste Processing Facility. "Solid Waste <br />Processing Facility" shall be defined as set forth in <br />section 604.02 of the City Code. <br /> <br />73A. Transfer station. "Transfer station" shall be <br />defined as set forth in section 604.02 of the City <br />Code. <br /> <br />76A. Waste Burning Facility. "Waste Burning <br />Facility" shall be defined as set forth in section <br />604.02 of the city Code." <br /> <br />B. section 900.10(1) is amended to add to the list of <br />zoning districts within the City of Elk River the following: <br /> <br />"SWF Solid Waste Facility Overlay District" <br /> <br />C. Section 900.12 is amended to add thereto the <br />following new Section 14, as follows: <br /> <br />"14. SWF Solid Waste Facility Overlay Zoning <br />District. <br /> <br />! <br />
