<br />ELK RIVER TOWN BOARD MEETING <br />January 28, 1896 <br /> <br /> <br />The Board of Supervisors met at the Town Clerk’s office at 10 o’clock A.M. pursuant to <br />adjournment. Full Board present. This being the time and place set for the hearing on the road <br />petitions signed by F.W. Nickerson, W.G. Babcock, John Blocher, and Henry Castle and others for <br />four new roads. <br /> <br />The road petition signed by F.W. Nickerson and others for a new road beginning at a point on the <br />south line of section 15, Township 33, Range 26 which point is 7 chains east from the quarter <br />section post in the south line of said section (15) and running in a easterly and northeasterly <br />direction as described in said petition and it appearing to the Board by the affidavit of John Blocher <br />that he had served copies of the notice of hearing upon each of the occupants of the land through <br />which the road may pass, at least ten days prior to this meeting, and it further appearing to the <br />Board by affidavit of Andrew Davis that he had posted copies of the notice of hearing at least ten <br />days prior, hereto, in three public places in said town. <br /> <br />The Board proceeded to listen to arguments for and against the laying out of roads. They having <br />personally viewed and examined the proposed routes of the same. <br /> <br />Wm. Wruck owning the S.E. ¼ of N.W. ¼ Sec. 13 Township 33, Range 26 appeared and asked that <br />damages to the amount of $5.00 be allowed him in consequence of the laying out of said road. On <br />motion damages to the said amount of $5.00 were allowed said Wm. Wruck. <br /> <br />No one appearing further to offer objections to the laying out of said road and it appearing to the <br />Board to be necessary and proper that the same should be laid out, located and established, on <br />motion it was voted that the prayer of the petitioners be granted and that a public road four in width <br />be laid out, located and established accordingly. A survey was ordered made by J.H. Williams, <br />surveyor. It being also the time and place set for the hearing on the road petition signed by Henry <br />Castle and others for a new road beginning at a point 2 rods south from a point on the south line of <br />section (23), Township 33, Range 26 and 21 74/100 chains west from the south east corner of said <br />section 23 and from said first named point running westerly as described in said petition. <br /> <br />And it appearing of the Board by affidavit of W.L. Babcock that he had served copies of the notice <br />of hearing upon each of the occupants of the land through which the said road may pass at least ten <br />days prior to this meeting and it further appearing to the Board by affidavit of Andrew Davis that he <br />had posted copies of the Notice of hearing in three public places in said town at least ten days prior <br />hereto. <br /> <br />No one appearing to offer objections to the laying out of said road and it appearing to the Board to <br />be necessary and proper that the same should be laid out, located and established. <br /> <br />On motion it was voted that the prayer of the petitioners be granted and a public road four rods in <br />width be laid out, located and established accordingly.
