<br />ORDINANCE 84-10 <br /> <br />AN ORDINANCE ESTABLISHING A FEE FOR SOLID WASTE ACCEPTED AND DISPOSED OF <br />AT THE ELK RIVER LANDFILL <br /> <br />WHEREAS, The City of Elk River was granted the authority to charge a fee not to <br />exceet fifteen cents (15~) per cubic yard for solid waste accepted and <br />disposed of on land to operators of facilities for mixed municipal solid <br />waste located within the City of Elk River, by Chapter 644, Section 47 <br />of Laws of Minnesota of 1984; and <br /> <br />WHEREAS, The City of Elk River deems that the imposition of the authorized fee on <br />solid waste accepted at the Elk River Landfill is in the City's best <br />interests. <br /> <br />THEREBY, THE CITY COUNCIL OF THE CITY OF ELK RIVER DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. That the Elk River City Code of Ordinances be amended to add <br />Section 603 titled, "Landfill Provisions", which shall read as follows: <br /> <br />603.00 - Any operator of facilities for mixed municipal solid waste within <br />the City of Elk River accepting solid waste and disposing of such waste <br />on land shall pay a fee of fifteen cents (15~) per cubic yard to the City <br />of Elk River, which shall go to the City's general fund for purposes of <br />mitigating and compensating for the local risks, costs and other adverse <br />affects of the facilities. <br /> <br />Section 2.
