<br />. <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE 88 - 21 <br /> <br />AN ORDINANCE AMENDING THE CODE OF ORDINANCES <br />FOR THE CITY OF ELK RIVER <br />SECTION 604.08(3} <br />TO INCREASE THE CITY LANDFILL FEE <br /> <br />The City Council of the City of Elk River does ordain as <br />f llows: <br /> <br />Section 1. The Code of Ordinances for the City of Elk <br />Rver, Section 604.83(3} is amended to read as follows: <br /> <br />3. In addition to the application fee and annual <br />license fees required by Sections 1 and 2 above, <br />any operator of a facility for the disposal of <br />mixed municipal solid waste located within the City <br />of Elk River shall pay a fee of $.35 per cubic yard <br />of waste or its equivalent disposed of at the <br />facility. The revenue from this fee shall be <br />credited to the City's general fund. Revenue <br />produced by $.25 of the fee shall be used only for <br />pruposes of landfill abatement or for purposes of <br />mitigating and compensating the local risks, costs <br />and other adverse effects of such facilities. <br />Revenue produced by $.10 of the fee may be used for <br />any general fund purpose. Solid waste facility <br />operators shall pay this fee on a monthly basis. <br /> <br />Section 2.
