<br />. <br /> <br />ORDINANCE 89 - 21 <br /> <br />AN ORDINANCE AMENDING THE CITY OF ELK RIVER ZONING MAP TO ZONE <br />CERTAIN PROPERTY FROM PUD (PLANNED UNIT DEVELOPMENT) TO <br />C-3/HIWAY COMMERCIAL AND <br />R-2B (TOWNHOUSE, MULTIFAMILY/RESIDENTIAL) <br /> <br />The City Council of the City of Elk River does ordain as follows: <br /> <br />Section 1. The duly adopted Zoning Map of the City of Elk River is <br />hereby amended to zone the property described as: <br /> <br />. <br /> <br />That part of the Southeast Quarter of the Northeast Quarter of Section <br />34, Township 33, Range 26, Sherburne County, Minnesota described as <br />commencing at the intersection of the South line of said Southeast <br />Quarter of the Northeast Quarter with said Easterly line of the <br />right-of-way of U.S. Highway No. 169; thence Northwesterly along said <br />right-of-way 176.46 feet; thence Northeasterly at right angles 210.00 <br />feet to the point to be hereafter known as Point "A" for the purposes of <br />this description; thence Southeasterly parallel with said right-of way <br />to intersect said South line of the Southeast Quarter of the Northeast <br />Quarter, said point of intersection being the actual point of beginning <br />of the land to be hereby described; thence return Northwesterly along <br />said parallel line to said Point "A"; thence Northeasterly at right <br />angles 80.00 feet; thence Northwesterly parallel with said right-of-way <br />to intersect the North line of the South 417.42 feet of said Southeast <br />Quarter of the Northeast Quarter: thence east along said North line of <br />the South 417.42 feet a distance of 465.28 feet; thence South at right <br />angles 417.42 to said South line of the Southeast Quarter of the <br />Northeast Quarter; thence West along said South line to the point of <br />beginning. <br /> <br />The eastern 140 ft. of the parcel described in exhibit "A" as measured at <br />right angles from the western right-of-way of Auburn Place as dedicated on <br />the duly recorded plat of Barrington Place from PUD to R-2B; and the parcel <br />described in exhibit "A" except for the eastern 140 ft. thereof from PUD TO <br />C-3. <br /> <br />Section 2.
