<br />. <br /> <br />. <br /> <br />. <br /> <br />ORDINANCE 89-18 <br /> <br />AN ORDINANCE AMENDING THE CODE OF ORDINANCES <br />FOR THE CITY OF ELK RIVER <br />SECTION 802.02(3) <br />TO ALLOW THE SALE OF INTOXICATING MALT LIQUOR AT ON SALE <br /> <br />The City Council of the City of Elk River does ordain as <br />follows: <br /> <br />Section 1. The Code of Ordinances for the City of Elk <br />River, Section 802.02(3) is amended to read as follows: <br /> <br />3. On-Sale Wine Licenses. On-sale wine licenses shall <br />be issued only to restaurants meeting the qualifications of <br />Minnesota Statutes, Section 340A.404, Subd. 5, and shall permit <br />only the sale of wine not exceeding fourteen percent (14%) <br />alcohol by volume for consumption on the licensed premises <br />only, in conjunction with the sale of food. <br /> <br />The sale of intoxicating malt liquor at on-sale shall be <br />allowed to any restaurant establishment which is also licensed <br />to sell wine and nonintoxicating malt liquors at on-sale <br />pursuant to Section 340A. 411 of the Minnesota State Statutes, <br />and whose gross receipts are at least 60 percent attributable <br />to the sale of food. If these qualifications are met, no <br />additional license shall be required to sell intoxicating malt <br />liquor at on sale. <br /> <br />Section 2.
