<br />. <br /> <br />ORDINANCE 89 - ~ <br /> <br />AN ORDINANCE AMENDING THE CODE OF ORDINANCES <br />FOR THE CITY OF ELK RIVER <br />SECTION 1406 <br />TO RESTATE THE BENEFIT RATIO AND TO <br />EXCLUDE CERTAIN COMMERCIAL AND INDUSTRIAL LANDS <br />FROM THE RURAL SERVICE DIS~RICT AND INCLUDE SUCH LANDS <br />IN THE URBAN SERVICE DISTRICT <br /> <br />The City Council of the City of Elk River does ordain as <br />follows: <br /> <br />Section 1. The Code of Ordinances for the City of Elk <br />River, is amended to restate Section 1406.00 and to create a <br />new Section 1406.02, each section to read as follows: <br /> <br />Section 1406 - Rural/Urban Service Districts <br />. <br /> <br />1406.00 - Amendment of Benefit Ratio. The benefit ratio as <br />defined in Minnesota Statutes, Section 272.67, and <br />established as 0.25 in Section 7 of the State of Minnesota <br />Municipal Board Order regarding the consolidation of the <br />Town of Elk River and the City of Elk River, dated <br />October 31, 1977, is hereby amended to a ratio of 0.6. <br /> <br />. <br /> <br />1406.02 - Rural and Urban Service Districts. The Rural <br />Service District established by the State of Minnesota <br />Municipal Board order, dated October 31, 1977, may be and <br />has been changed from time to time by City Council action <br />to exclude lands from the Rural Service District pursuant <br />to Minnesota Statutes, Section 272.67. The Urban Service <br />District shall include all lands within the boundaries of <br />the City of Elk River which are not included in the Rural <br />Service District. <br /> <br />Section 2. Commercial and Industrial lands identified in <br />Exhibit A hereto are hereby excluded from the Rural Service <br />District and are included in the Urban Service District. <br /> <br />Section 3.
