<br />e <br /> <br />ORDINANCE 90 - 13 <br /> <br />AN ORDINANCE AMENDING THE CODE OF ORDINANCES <br />FOR THE CITY OF ELK RIVER <br />SECTION 900.38 and 1008.04 <br />RELATING TO THE SUBDIVISION OF LAND <br /> <br />The City Council of the City of Elk River does ordain as <br />follows: <br /> <br />The Code of Ordinances for the City of Elk River, Section <br />900.38 is amended to add: <br /> <br />d. No building permit shall be issued for the <br />development of property zoned for commerical, <br />industrial or multifamily structure of four (4) <br />dwelling units or greater for property that is not <br />platted in accordance with the requirements of <br />Chapter X of the City Code. <br /> <br />The Code of Ordinances for the City of Elk River, Section <br />1008.04 is amended to read as follows: <br /> <br />e <br /> <br />1008.04 Scope and Legal Authority. The rules and <br />regulations governing plats and subdivision of land <br />contained herein shall apply within the boundaries of the <br />Ci ty of Elk River ( the City) in accordance with and as <br />permi tted by Minnesota Statutes (the Law). No building <br />permi t shall be issued for development of property zoned <br />for commerical, industrial and multifamily structures of <br />four (4) dwelling units or greater for property that is <br />not platted in accordance with the requirements of this <br />Chapter. Except in the case of resubdivision, this <br />Ordinance shall not apply to any lot or lots forming a <br />part of a subdivision recorded in the office of the <br />Register of Deeds prior to the effective date of this <br />Ordinance, nor is it intended by this Ordinance to repeal, <br />annul or in any way impair or interfere with existing <br />provisions of other laws or ordinances except those <br />specifically repealed by, or in conflict with, this <br />Ordinance, or with restrictive covenants running with the <br />land. Where this Ordinance imposes a greater restriction <br />upon the land than is imposed or required by such existing <br />provisions by law, ordinance, contract, covenants or deed, <br />the provisions of this Ordinance shall control. <br /> <br />- <br />
