<br />. <br /> <br />ORDINANCE 92 - -2 <br /> <br />AN ORDINANCE AMENDING CHAPTER IX OF THE ELK RIVER CITY CODE <br />TO SPECIFICALLY IDENTIFY CONDITIONAL USES IN THE SWF, SOLID <br />WASTE FACILITIES OVERLAY DISTRICT <br /> <br />The City Council of the City of Elk River does hereby ordain as <br />follows: <br /> <br />Section 1. That Section 900.12(16)(a) of the City of Elk <br />River Code of Ordinances be amended to read as follows: <br /> <br />a. Uses - The Solid Waste Facilities Overlay District <br />is an overlay zoning district. Land zoned into the Solid <br />Waste Facilities Overlay District will also remain in its <br />original zoning district (the Underlying Zoning <br />District). All permitted, accessory, and conditional uses <br />allowed in the Underlying Zoning District will continue to <br />be allowed on land zoned into the Solid Waste Facilities <br />Overlay District, subject to all restrictions and <br />requirements applicable in the Underlying District. In <br />addition to the uses allowed in the Underlying Zoning <br />District, there shall be allowed in the Solid Waste <br />Facilities Overlay District the following conditional <br />uses, subject to all requirements of the City Code for the <br />establishment and operation of such uses: <br /> <br />a. Solid Waste Facilities licensed under Section 604 <br />of the City Code. <br /> <br />. <br /> <br />b. Solid Waste Processing Facilities licensed under <br />Section 604 of the City Code. <br /> <br />c. Sanitary Landfills licensed under Section 604 of <br />the City Code. <br /> <br />d. Waste burning facilities licensed under Section <br />604 of the City Code. <br /> <br />e. Transfer stations licensed under Section 604 of <br />the City Code. <br /> <br />Section 2. That Section 900.12(16)(d) of the City of Elk <br />River Code of Ordinances shall be deleted. <br /> <br />Section 3.
