<br />. <br /> <br />. <br /> <br />. <br /> <br />THE CITY COUNCIL <br />FOR THE <br />CITY OF ELK RIVER, MINNESOTA <br /> <br />RESOLUTION NO. 87- 70 <br /> <br />A RESOLUTION AMENDING THE DEVELOPMENT PROGRAM FOR <br />DEVELOPMENT DISTRICT NO. 1 AND AMENDING THE BOUNDARIES OF <br />DEVELOPMENT DISTRICT NO.1. <br /> <br />The city Council for the City of Elk River (the City) <br />acting pursuant to its authority under Minnesota Statutes, <br />Sections 469.124, et seq., hereby finds, determines and <br />resolves as follows: <br /> <br />FINDINGS <br /> <br />1. That Development District No.1 was designated as a <br />municipal development district pursuant to Minnesota Statutes <br />Chapter 472A, and the Development Program for Development <br />District No. 1 was approved, by Resolution of the City Council <br />of the City of Elk River dated April 1, 1985, and amended by <br />resolution of the City Council of the City of Elk River dated <br />January 27, 1986. <br /> <br />2. That Development District No.1 has been implemented, <br />pursuant to the Development Program for Development District <br />No.1 and relevant Minnesota Statutes. <br /> <br />3. That the Development Program anticipates and provides <br />for the amendment of the Development Program and/or the <br />amendment of the boundaries of the Development District as <br />necessary to provide necessary public improvements and <br />utilities for new commercial and industrial development ln <br />those areas in the City designated for these uses. <br /> <br />4. That implementation of Development District No.1 has <br />attracted new commercial and industrial development to the <br />development district. <br /> <br />5. That commercial and industrial development has not <br />occurred and will not occur in certain other areas of the City <br />designated for these uses unless and until necessary public <br />improvements and facilities are provided. <br /> <br />6. That the necessary public improvements and facilities <br />cannot be provided, and new commercial and industrial <br />development will not occur, unless these areas of the City are <br />placed within Development District No. 1 and the Development <br />Program is amended to provide for the financing of these <br />improvements. <br />
