THE CITY COUNCIL FOR THE CITY OF ELK RIVER, MINNESOTA RESOLUTION NO. 87- 70 A RESOLUTION AMENDING THE DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT NO. 1 AND AMENDING THE BOUNDARIES OF DEVELOPMENT DISTRICT NO.1. The city Council for the City of Elk River (the City) acting pursuant to its authority under Minnesota Statutes, Sections 469.124, et seq., hereby finds, determines and resolves as follows: FINDINGS 1. That Development District No.1 was designated as a municipal development district pursuant to Minnesota Statutes Chapter 472A, and the Development Program for Development District No. 1 was approved, by Resolution of the City Council of the City of Elk River dated April 1, 1985, and amended by resolution of the City Council of the City of Elk River dated January 27, 1986. 2. That Development District No.1 has been implemented, pursuant to the Development Program for Development District No.1 and relevant Minnesota Statutes. 3. That the Development Program anticipates and provides for the amendment of the Development Program and/or the amendment of the boundaries of the Development District as necessary to provide necessary public improvements and utilities for new commercial and industrial development ln those areas in the City designated for these uses. 4. That implementation of Development District No.1 has attracted new commercial and industrial development to the development district. 5. That commercial and industrial development has not occurred and will not occur in certain other areas of the City designated for these uses unless and until necessary public improvements and facilities are provided. 6. That the necessary public improvements and facilities cannot be provided, and new commercial and industrial development will not occur, unless these areas of the City are placed within Development District No. 1 and the Development Program is amended to provide for the financing of these improvements.
