<br />RESOLUTION 87-48 <br /> <br />RESOLUTION ACCEPTING 2l8TH AVENUE AS A CITY PUBLIC STREET <br />AND ORDERING GRAVEL IMPROVEMENTS ON 2l8TH AVENUE <br /> <br />. <br /> <br />WHEREAS, <br /> <br />the Elk River City Council, on December 17, 1984, <br />received and accepted a 100% petition from property <br />owners on 2l8th Avenue requesting the City to accept <br />2l8th Avenue as a municipal public street, and; <br /> <br />WHEREAS, Council action on December 17, 1984, directed the <br />City Street Department to begin performing maintenance <br />on 2l8th Avenue, and the City to plan the gravel <br />improvement for 2l8th Avenue, which included the <br />obtaining of needed right-of-way easements, for the <br />1985 construction season, and; <br /> <br />WHEREAS, the City has maintained 2l8th Avenue since this <br />December 17, 1984, Council Meeting, but the gravel <br />improvements have not taken place, and; <br /> <br />WHEREAS, on August 24, 1987, the Elk River City Council again <br />received a 100% petition from the assessable property <br />owners requesting the previously committed gravel <br />improvements to be completed and waiving the property <br />owners rights to a public hearing and waiving the <br />property owners rights to object to the assessment of <br />said improvements, and; <br /> <br />. <br /> <br />WHEREAS, <br /> <br />the City Council of the City of Elk River now desires <br />to follow through with the gravel improvement as agreed <br />upon in 1984, and; <br /> <br />WHEREAS, it has been determined by the City Council of the City <br />of Elk River that the gravel improvement of 2l8th <br />Avenue is not in conflict with the approved 8/10/87 <br />City assessment policy as the City is following through <br />on a previous committment prior to the adoption of this <br />assessment manual, and; <br /> <br />WHEREAS, the City Engineer and the City Street Superintendent <br />has determined that the gravel improvements on 2l8th <br />Avenue can be accomplished for an amount not to exceed <br />$2,800 for material and labor. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Elk River that the City Street Crew is hereby <br />authorized to complete the gravel improvements to 2l8th <br />Avenue, and once completed, that 2l8th Avenue is <br />accepted as a municipal public street. <br /> <br />BE IT FURTHER RESOLVED by the City Council of the City of Elk <br />River that this improvement is not considered to be <br />inconsistent with the adopted 8/10/87 City assessment <br />manual as the commitment to improve 2l8th Avenue was <br />done on December 17, 1984, pending the City obtaining <br />adequate easements. <br /> <br />. <br />
