<br />. <br /> <br />. <br /> <br />. <br /> <br />RESOLUTION 86-23 <br /> <br />RESOLUTION ORDERING PREPARATION OF PLANS AND SPECIFICATIONS <br />FOR SANITARY SEWER, WATER MAIN, STORM DRAINAGE AND STREET <br />IMPROVEMENTS FOR DEERFIELD THIRD ADDITION <br /> <br />WHEREAS, a certain petition requesting the improvement of <br />sanitary sewer, water main, storm drainage, and street <br />improvements on the property described by the following <br />legal description: <br /> <br />The East Half of the Southeast Quarter of Section 27 <br />and the Northwest Quarter of the Southwest Quarter of <br />Section 26 and the North 396.00 Feet of the West 660.00 <br />Feet of the Northeast Quarter of the Northeast Quarter <br />of Section 34 and that part of the Northwest Quarter of <br />the Northeast Quarter of said Section 34 lying East of <br />U.S. Highway No. 169 and lying North of the South <br />533.32 feet thereof all in Township 33, Range 26, <br />Sherburne County, Minnesota. (Deerfield Third <br />Subdivision). <br /> <br />was duly presented to the Council on the 17th day of <br />March 1986; and, <br /> <br />WHEREAS, <br /> <br />pursuant to Resolution 86-20 adopted by the Elk River <br />City Council on March 17, 1986, a report has been <br />prepared by Mr. Terry J. Maurer of Maier Stewart and <br />Associates, Inc. with reference to the improvements, <br />and this report was received by the Council on April 7, <br />1986; <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City <br />Council of the City of Elk River, Minnesota: <br /> <br />1. The Council finds and determines that said petition <br />was signed by all owners of real property of <br />Deerfield Third Addition. <br /> <br />2. Mr. Terry J. Maurer is hereby designated as the <br />engineer for this improvement. He shall prepare <br />plans and specifications for the making of such <br />improvement. <br /> <br />3. The preparation of the plans and specifications for <br />the making of such improvements shall be contingent <br />upon the receipt of $25,000 cash deposit for letter <br />of credit from the petitioners to provide the cost <br />of the preparation of said plans and specifications <br />inCluding the feasibility study. <br />
