RESOLUTION 86-23 RESOLUTION ORDERING PREPARATION OF PLANS AND SPECIFICATIONS FOR SANITARY SEWER, WATER MAIN, STORM DRAINAGE AND STREET IMPROVEMENTS FOR DEERFIELD THIRD ADDITION WHEREAS, a certain petition requesting the improvement of sanitary sewer, water main, storm drainage, and street improvements on the property described by the following legal description: The East Half of the Southeast Quarter of Section 27 and the Northwest Quarter of the Southwest Quarter of Section 26 and the North 396.00 Feet of the West 660.00 Feet of the Northeast Quarter of the Northeast Quarter of Section 34 and that part of the Northwest Quarter of the Northeast Quarter of said Section 34 lying East of U.S. Highway No. 169 and lying North of the South 533.32 feet thereof all in Township 33, Range 26, Sherburne County, Minnesota. (Deerfield Third Subdivision). was duly presented to the Council on the 17th day of March 1986; and, WHEREAS, pursuant to Resolution 86-20 adopted by the Elk River City Council on March 17, 1986, a report has been prepared by Mr. Terry J. Maurer of Maier Stewart and Associates, Inc. with reference to the improvements, and this report was received by the Council on April 7, 1986; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City Council of the City of Elk River, Minnesota: 1. The Council finds and determines that said petition was signed by all owners of real property of Deerfield Third Addition. 2. Mr. Terry J. Maurer is hereby designated as the engineer for this improvement. He shall prepare plans and specifications for the making of such improvement. 3. The preparation of the plans and specifications for the making of such improvements shall be contingent upon the receipt of $25,000 cash deposit for letter of credit from the petitioners to provide the cost of the preparation of said plans and specifications inCluding the feasibility study.
