<br />. <br /> <br />. <br /> <br />. <br /> <br />The City Council for the City of Elk River, Minnesota <br /> <br />Resolution No. 85-~ <br /> <br />A RESOLUTION AMENDING THE DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT <br />NO. 1 TO AUTHORIZE CERTAIN ADDITIONAL PUBLIC INPROVEMENT ACTIVITIES. <br /> <br />WHEREAS, the City Council for the City of Elk River, by <br />Resolution No. 85-10, adopted April 1, 1985, designated Development <br />District No. 1 as a municipal development district pursuant to <br />Chapter 472A of Minnesota Statutes and approved the development <br />program for Development District No.1; and <br /> <br />WHEREAS, the City Council for the City of Elk River, by <br />Resolution No. 85-30, adopted July 22, 1985, established Tax Increment <br />Financing District No. 2 and approved the Tax Increment Financing <br />Plan for Tax Increment Financing District No.2; and <br /> <br />WHEREAS, the Tax IncrementrFinancing Plan for-'1'ax Increment Dis<t.rict <br />No. 2 authorizes payment from taxinGrement funds for certain public <br />improvements within Tax Increment District No. 2 including the <br />installation of utilities, the construction of parking facilities, <br />landscaping, curb and gutter, and sidewalks, and the payment of sewer <br />and water availability charges for the Evans Park Project; and <br /> <br />WHEREAS, it has come to the attention of the City Council of the <br />City of Elk River that the Development Program for Development District <br />No. 1 should also specifically authorize the construction of the public <br />improvements proposed to be paid for with tax increment generated by <br />Tax Increment Financing District No.2. <br /> <br />THEREFORE, the City Council for the City of Elk River, acting <br />pursuant to its authority under Chapter 472A of Minnesota Statutes, <br />hereby resolves as follows: <br /> <br />1. The Development Program for Development District No. 1 <br />be amended by adding a new section IF5 as follows: <br /> <br />5. Evans Park pUblic Improvements. <br /> <br />The installation of utilities, the construction of <br />parking facilities, landscaping, curb and gutter, <br />sidewalks, and the payment of sewer and water avail- <br />ability charges for the Evans Park Project. <br /> <br />2. The development program for Development District No. I shall <br />in all other respects remain in full force and effect with- <br />out change. <br />
