<br />Request for Action <br /> <br /> <br /> <br /> <br /> <br />To Item Number <br />Mayor and City Council 8.1 <br />Agenda Section Meeting Date Prepared by <br />General Business January 19, 2021 Amanda Erickson, Environmental Coordinator <br />Item Description Reviewed by <br />New Look Contracting, Inc. extended hours Brandon Wisner, Engineering Project Manager <br />request for LORE project <br />Reviewed by <br />Cal Portner, City Administrator <br /> <br />Action Requested <br />Approve, by motion, extended hours operating hours for New Look Contracting, Inc. for the LORE project. <br /> <br />Background/Discussion <br />New Look Contracting, Inc. is set to begin dredging and hauling material from Lake Orono for the LORE project. <br />The work requires the lake and lake bottom be frozen to support the weight of dredging and hauling equipment. <br />The unseasonably warm weather has prevented them from fully mobilizing to keep the project on schedule. <br />Because dredging must be completed during the winter months, New Look is requesting the city allow extended <br />work hours in the coming weeks to keep the project on schedule. <br /> <br />The city code (Sect. 46.37) provides that construction activities between the hours of 9 p.m. and 6 a.m. constitute a <br />nuisance. However, the city has allowed construction activities between these hours in unique circumstances, most <br />frequently to allow mining and hauling operations in support of MnDOT nighttime road projects. <br /> <br />Allowing nighttime operations may affect residential properties surrounding and adjacent to the lake, although <br />noise impacts may be mitigated somewhat because windows are closed in winter. Not allowing nighttime <br />operations could threaten project completion before the spring thaw when these operations are impossible. <br /> <br />New Look is requesting to haul 24-hours a day for three weeks, beginning either the week of January 25 or <br />February 1, weather dependent. During this period, they will only dredge and haul from the upper lake (north of <br />Highway 10) at the approved access location. No work will occur on Sundays. They estimate approximately 20 <br />trucks will be used during this time.
