<br />. <br /> <br />. <br /> <br />. <br /> <br />CITY OF ELK RIVER <br />COUNTY OF SHERBURNE <br /> <br />RESOLUTION <br /> <br />89-64 <br /> <br />WHEREAS, the building, located at 15536 Cleveland Street, <br />City of Elk River, County of Sherburne, State of Minnesota, and <br />legally described as part of the Northwest Quarter of the <br />Northeast Quarter of Section 24, Township 32, Range 26, <br />Sherburne County, Minnesota, PID 117-000-241-213 (Subject <br />Property) burned on or about September 12, 1989; and <br /> <br />WHEREAS, the City Council for the City of Elk River finds <br />as follows: <br /> <br />1. That RCM International, a producer of <br />poly vinyl chloride products, operates <br />its business on the Subject Property. <br /> <br />2. That the Subject Property is presently <br />unoccupied. <br /> <br />3. That the remaining portions of the <br />structure are unsound. <br /> <br />4. <br /> <br />That there is broken glass, metal <br />objects, and unsecured portions of the <br />structure which threaten the public <br />safety. <br /> <br />5. That the subject property is an <br />attraction to children and poses an <br />unreasonable risk of harm to children <br />and others. <br /> <br />6. That there is a threat of contamination <br />to the on-site well. <br /> <br />7. That there is a threat of contamination <br />to the surrounding soils from the on- <br />site septic system. <br /> <br />8. That the building is beyond repair. <br /> <br />9. That the aforementioned conditions <br />present a hazard to the public safety <br />or health. <br /> <br />WHEREAS, the debris from said fire has left the Subject <br />Property in a hazardous condition; and <br /> <br />WHEREAS, the legal owner, John C. Hoglund, has not yet <br />cured the aforesaid hazardous conditions. <br />
