<br />. <br /> <br />. <br /> <br />. <br /> <br />NOTICE OF COMPLETION OF PROCEEDINGS <br /> <br />RESOLUTION 89-44 <br />A RESOLUTION OF THE CITY OF ELK RIVER <br />A RESOLUTION FOR VACATING A PORTION OF A DRAINAGE EASEMENT <br /> <br />WHEREAS, a majority of the property owners abutting the drainage <br />easement have requested the City Council in a petition <br />dated 5/23/89 to vacate such easement according to law; <br />and, <br /> <br />WHEREAS, a public hearing was held on 6/19/89 before the City <br />Council at the Elk River Public Library on such <br />petition after due published and posted notice had been <br />given, as well as personal notice to affected property <br />owners by the clerk on 6/4/89 and all persons <br />interested were given an opportunity to be heard; and, <br /> <br />WHEREAS, it appears that it will be in the best interest of the <br />City to approve such petition. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that such petition is hereby <br />granted and the portion of the drainage easement <br />described as follows is hereby vacated: <br /> <br />That part of the drainage easement within Lot 24, Block 7, <br />BRENTWOOD, Sherburne county, Minnesota which lies East of the <br />following described Line B: <br /> <br />Line A is described as a line extended from a point on the North <br />line of said Lot 24 distant 96.17 feet West of the Northeast <br />corner of said Lot 24, as measured along said North line, <br />Southwesterly to a point on the South line of said Lot 24 distant <br />125.00 feet West of the Southeast corner of said Lot 24, as <br />measured along said South line. <br /> <br />Line B is described as follows: Commencing at a point on the <br />North line of said Lot 24 distant 96.17 feet West of the <br />Northeast corner of said Lot 24 distant 96.17 feet West of the <br />Northeast corner of said Lot 24, as measured along said North <br />line, said point also being the Northerly point of the above <br />described Line A a distance of 15.00 feet to the Point of <br />Beginning of the Line to be described; thence southerly <br />deflecting to the left 26 degrees 53 minutes 00 seconds a <br />distance of 80.00 feet; thence Southwesterly deflecting to the <br />right 73 degrees 07 minutes 00 seconds a distance of 51.00 feet, <br />more or less, to intersect the above described Line A and there <br />terminating. <br /> <br />Adopted by the City Council of the City <br />day of June, 1989. <br /> <br />of Elk River this 19th <br />/ <br />j:vv~ ffZ~: <br /> <br />ames A.
